CONCORD, NH (AP) – The trial of a truck driver accused of causing the deaths of seven motorcyclists in northern New Hampshire in 2019 is now set to begin in July – more than three years after the crash – to give the defense more time to find and work with a crash reconstruction expert.
Volodymyr Zhukovskyy, 25, of West Springfield, Mass., Was days away from jury selection in November when his attorneys filed a motion saying they could no longer present their accident reconstruction expert at trial.
Their decision was based on information prosecutors had given them about the expert’s previous employment with the Massachusetts State Police, which referred to disciplinary action. The expert had been working with the defense since August 2019.
“We encountered considerable difficulty in identifying a qualified expert, with the appropriate resources and willing to accept the case,” defense attorney Jay Duguay told Coos County Superior Court Judge Peter Bornstein, at a status conference on the case on Tuesday.
“Unfortunately, I learned this afternoon that one of our more optimistic prospects had indicated that they were not interested in taking the matter into their own hands. So I have inquiries and we are waiting. news from some people, ”Duguay said.
The lawyers and Bornstein also spoke of scheduling conflicts. Bornstein planned to issue an order on Thursday with the new jury selection and trial dates. Another status conference was scheduled for January.
Zhukovskyy has pleaded not guilty to several counts of negligent homicide, manslaughter, drunk driving and reckless driving resulting from the accident in Randolph on June 21, 2019. He is in jail since the accident.
The victims, members of the Jarheads Motorcycle Club, were from New Hampshire, Massachusetts and Rhode Island.
